Wavier & Rental Agreement

This Rental Agreement consists of the terms and conditions for renting a vehicle from Beach Adventure Rentals. 

Renter must sign this agreement at pickup. 

All RENTERS and AUTHORIZED DRIVERS must:

1. Possess a valid driver's license issued by a US State or territory

2. Be a minimum of 21 years of age 

3. Have active liability insurance coverage on a private owned vehicle

RENTER’S driver’s license MUST be presented in person when the VEHICLE is picked up. There are no exceptions to this rule. A photograph of the renters driver’s license will be made at this time. 

A. AGREEMENT

YOU guarantee the VEHICLE will be operated as required by this Agreement. Except for the ordinary wear and tear, YOU must return the VEHICLE in the same condition. YOU agree to stop driving the VEHICLE should the dashboard warning lights become illuminated during the rental period and YOU agree to inform Beach Adventure Rentals of the problem as soon as possible. B. AUTHORIZED DRIVER (S)

Only the renter or an individual authorized by the renter may operate the vehicle. Under this agreement, an AUTHORIZED DRIVER is a person given permission by the renter and who otherwise meets the criteria to rent a vehicle from us.

C. RENTAL FEE and ASSOCIATED FEES 

The total rental amount is the amount listed in the online booking form plus applicable taxes & fees. 

This amount is clearly defined in the total line. A $100 refundable deposit is charged at time of rental. This will be refundable to you upon inspection of the Jeep for condition and a full take of fuel. 

D. PICK UP & RETURN

1. You will be contacted via text or telephone call at the telephone number listed on the online reservation form. We will reach out at least 24 hours in advance of your scheduled pick up date and again one hour before pick up to confirm your exact pickup time and address. Pick up will be 800 Hwy 501 Myrtle Beach, SC 29577 

2. The vehicle must be dropped off by 10am on the returned date. We DO NOT pick up returns. You must return the vehicle to the specified address in Myrtle, Beach, SC 29577

3. The vehicle has a FULL TANK of gas. You must refuel the Jeep to the full level. A $100 refundable deposit will be authorized to your card at time of rental. This $100 deposit will be returned to you when you return the Jeep full of fuel. 

4. You are responsible for all legal charges including parking and traffic fines, penalties, cost and expenses assessed against the vehicle during your rental period.

5. Photographs showing all “Four Corners” of the vehicle will be made at pick up and again upon your return of the vehicle. We encourage you to take before and after photographs as well and document any damage you note prior to leaving in the vehicle. 

E. PROHIBITED USES OF THE VEHICLE

The vehicle may NOT be used: 

1. To carry persons or property for hire

2. To push or tow anything

3. To race or similar contest

4. Smoking. Vapes, e-cigarettes, Cigarettes, cigars and pipes and all other smoking devices are prohibited. 

5. For any illegal purpose or in the act of a crime, that could be charged as a misdemeanor or felony

6. While a driver is under the influence of alcohol or drugs or driving in a state of drowsiness

7. Outside the service area of Georgetown, Charleston and Horry Counties of South Carolina without prior written permission & consent from Beach Adventure Rentals 

8. Off road or on beaches

9. To transport weight exceeding the VEHICLES maximum capacity, or used to carry hazardous or explosive substances 

10. Used to transport passengers and occupants in excess of the number of seat belts in the vehicle or transport anyone in the cargo area of the vehicle.

F. TOP/DOOR REMOVAL

and STORAGE

Doors: You may remove the doors from the Jeep provided you have a safe space to store them without causing damage. Doors must be removed by you and stored at your location. 

TOPS: Are removable in varying degrees. You will be shown this when you pick up the Jeep. 

We do not remove or store doors or tops. 

You are responsible for any damages during storage and or removal.  It is YOUR responsibility to keep the Jeep dry and YOU are responsible for any damage caused by rain or water. 

If the vehicle is used to transport animals or firearms do so legally and remove them prior to return. You are responsible for DAMAGE or ADDITIONAL clean up costs associated with transporting pets. 

Prohibited use of the vehicle violates the agreement and voids the agreement and forfeits the amount paid.

G. INSURANCE

Your must have automotive liability insurance to rent from Beach Adventure Rentals. Your own insurance will be responsible for handling, defending and paying third-party claims for bodily injury, death or property damage caused by or arising from your use or operation of the vehicle during the RENTAL PERIOD. 

Beach Adventure Rentals does not provide RENTER or AUTHORIZED DRIVER with LIABILITY AUTOMOBILE INSURANCE or LIABILITY PROTECTION covering the use of this VEHICLE.

Under federal law (safe, accountable, flexible, efficient transportation equity act: a legacy for Users) (49 U.S.C., sec. 30101); the OWNER shall not be liable under the law of any state, by reason of being the OWNER of the VEHICLE for harm to persons or property that results or arises out of the use, operation or possession of the VEHICLE during RENTAL PERIOD by YOU and any other operator. Under section 30103 of the law, OWNER shall not be legally liable for any harm or torts caused by YOU or any other operator’s negligence or wrongdoing. In sum, there is no vicarious responsibility by the OWNER under federal, state or local laws. 

H. HANDLING ACCIDENTS AND OTHER OCCURRENCES

In the event of an accident, You must call the police or highway patrol immediately and secure a copy of the initial police report and any other information relevant to the accident. You must call us at 843-748-2029. 

We are not responsible for loss or damage to any property left in or on the vehicle. Beach Adventure Rentals is not responsible for loss of time, expenses, or any other incurred by you due to mechanical breakdown, accident, or any other causes. You hereby assume all risk of such loss or damage.

You agree Beach Adventure Rentals retains FULL OWNERSHIP of the VEHICLE.

You will be provided with one (1) set of keys that are to be surrendered upon return. You are responsible for the replacement cost of broken or lost keys.

You are responsible to know the laws of South Carolina pertaining to restraint of children in automobiles and traffic laws. We DO NOT provide child safety or booster seats.

I. CANCELLATION POLICY

Reservations canceled 48 hours in advance of the pickup date and time will receive a full refund minus the 3rd party booking fee specified at checkout. To cancel you must use the contact form at www.beachadventurerentals.com or call 843-748-2029. Cancellations made after 48 hours will receive a 50% refund 

Cancellations made after midnight on the beginning rental date are NONREFUNDABLE

J. NO SHOW POLICY

We will consider a “No show” a customer that does not show up to pick up the vehicle OR contact the Beach Adventure Rentals Representative within 1 hour of the AGREED UPON pick up time. No shows are subject to the Cancellation Policy
